Advertising Rules for Agent Websites

Question:
I want to start advertising on the internet and social media sites, but I want to make sure I’m complying with the law. What info must an agent include on his/her web page and/or social media sites?
Recommendation:
Web pages, Facebook, Pinterest, Twitter etc. have changed the way nearly all companies, including realtors, do business. It is becoming the norm, and not the exception, for realtors to advertise on the internet via websites, Facebook, Pinterest, Twitter, email, etc.In an effort to protect the general public from false and/or misleading internet advertising, the Louisiana Real Estate Commission has come up with guidelines outlining what needs be included on web based marketing tools.Louisiana Real Estate Commission Rules and Regulations, Chapter 25, Section 2515(c) appears to govern website and Facebook pages.According to this Section “C,” an associate broker or real estate agent advertising or marketing on a site on the Internet must include the following data on each page of the site on which the associate broker or real estate agent’s advertisement or information appears:1. the associate broker’s or real estate agent’s name;
2. the name or trade name of the licensed broker or agency listed on the license of the associate broker;
3. the city and state in which the broker’s main office or branch office is located.
4. the regulatory jurisdiction(s) in which the broker holds a real estate brokerage license.

So, for a realtor’s website and Facebook page, please adhere to this Section “C.”

Louisiana Real Estate Commission Rules and Regulations, Chapter 25, Section 2515(D) appears to cover emails and Twitter. Additionally, a Pinterest board could be considered a “bulletin board,” so Section “D” appears to cover Pinterest, as well.

According to this Section “D”, an associate broker or salesperson using any Internet electronic communication for advertising or marketing, included but not limited to, e-mail, email discussion groups, and bulletin boards, must include the following data on the first or last page of all communications:

1. the associate broker’s or salesperson’ name;
2. the name or trade name of the licensed broker or agency listed on the license of the salesperson or associate
